Definition

This page contains all the legal documents that govern how users interact with the Nigerent platform and how the platform operates.

Terms of Use

These Terms of Use govern your access to and use of the Nigerent platform. By accessing or using Nigerent, you agree to be bound by these terms.

1. About Nigerent

Nigerent Limited operates an online marketplace that connects prospective tenants, shortlet guests, and buyers with property owners and agents in Nigeria. Nigerent is a technology intermediary and is not a landlord, estate agent, or party to any tenancy, lease, shortlet, or sale agreement.

2. Eligibility

You must be at least 18 years old to use the platform. By using Nigerent you confirm that you meet this requirement and that the information you provide is accurate and truthful.

3. Your Account

You are responsible for keeping your login credentials confidential and for all activity under your account. Notify us at support@nigerent.com if you suspect unauthorised access.

4. Acceptable Use

You must not use the platform for any unlawful purpose, upload fraudulent or misleading content, attempt to bypass platform fees, harass other users, or interfere with the security or operation of the platform.

5. Enquiries and Bookings

Submitting an enquiry or booking request does not create a binding contract. Any resulting tenancy, lease, shortlet, or sale is solely between you and the relevant host or agent.

6. Changes and Termination

We may update these terms and may suspend or terminate accounts that breach them. Continued use of the platform after an update constitutes acceptance of the revised terms.

7. Governing Law

These terms are governed by the laws of the Federal Republic of Nigeria, and disputes are subject to the exclusive jurisdiction of the courts of Lagos State.

Privacy Policy

This Privacy Policy explains how Nigerent collects, uses, and protects your personal data in accordance with the Nigeria Data Protection Act 2023.

1. Information We Collect

We collect information you provide directly, such as your name, email, phone number, and any content you submit, together with usage data such as your IP address, device type, and pages visited.

2. How We Use Your Information

We use your data to operate and improve the platform, connect enquirers with property listers, send service messages, meet legal obligations, and keep the platform secure. We do not sell your personal data.

3. Legal Basis for Processing

We process your data where it is necessary to perform a contract, for our legitimate interests, with your consent, or to meet a legal requirement. You may withdraw your consent at any time.

4. Sharing of Information

We share data only with service providers who help us operate the platform, payment processors where applicable, and authorities where required by Nigerian law.

5. Data Retention

We keep your data for as long as your account is active or as needed to provide our services and meet our legal obligations.

6. Your Rights

You may request access to, correction of, or deletion of your data, object to certain processing, and lodge a complaint with the Nigeria Data Protection Commission.

7. Contact

For privacy questions or requests, contact our Data Protection Officer at support@nigerent.com.

Property Listing Policy

This policy sets out the standards that every property listing on Nigerent must meet.

1. Accuracy of Listings

Hosts are solely responsible for the accuracy, completeness, and legality of their listings, including descriptions, photographs, pricing, and availability.

2. Right to List

You may only list a property you own or are authorised to advertise, and you must hold all consents required to market the property.

3. Prohibited Listings

You must not post properties subject to legal proceedings that prevent occupation, duplicate listings, or listings that use misleading, fraudulent, or discriminatory content.

4. Media Standards

Photographs must depict the actual property being advertised. Watermarked, stock, or misleading images are not permitted.

5. Review and Removal

Nigerent reviews listings and may reject, edit, pause, or remove any listing that breaches this policy at its sole discretion.

Inspection Booking Policy

This policy explains how physical inspection bookings work on Nigerent and the responsibilities of each party.

1. Requesting an Inspection

You can request a physical inspection by submitting your preferred date and time through a property's inspection form. A request is confirmed only after it has been reviewed and approved.

2. Confirmation

You will receive an email once your inspection request is approved. Approval is subject to the availability of the host or agent.

3. Rescheduling and Cancellations

Please give reasonable notice if you need to reschedule or cancel. Repeated no-shows may affect your ability to book future inspections.

4. Conduct During Inspections

Inspections must be conducted respectfully and safely. Nigerent is not present at inspections and is not responsible for the conduct of any party.

5. Safety

Where possible, arrange inspections during daylight hours and inform someone you trust of your plans. Report any safety concerns to support@nigerent.com.

Billing, Payment & Refund Policy

This policy explains how fees, payments, and refunds are handled on the Nigerent platform.

1. Platform Fees

Access to the platform is currently free for enquirers and listers. Nigerent may introduce service or subscription fees in future with reasonable advance notice.

2. Payments

Where payment features are enabled, payments are processed by third-party payment providers. You agree to provide accurate billing information.

3. Subscriptions

Subscription plans, where offered, renew automatically at the end of each billing cycle unless cancelled before the renewal date.

4. Refunds

Refund eligibility depends on the specific service purchased and is assessed on a case-by-case basis. Approved refunds are returned using the original payment method.

5. Failed or Disputed Payments

We may suspend access to paid features where a payment fails or is disputed until the matter is resolved. Contact support@nigerent.com for billing enquiries.

Complaint & Dispute Resolution Policy

This policy explains how to raise a complaint and how disputes involving the Nigerent platform are resolved.

1. Raising a Complaint

You can raise a complaint by emailing support@nigerent.com with a clear description of the issue and any supporting information.

2. Our Response

We aim to acknowledge complaints within a reasonable time and to work with you towards a fair resolution.

3. Disputes Between Users

Any tenancy, lease, shortlet, or sale is between the user and the host or agent. Nigerent is not a party to these agreements but may provide relevant information to help resolve a dispute.

4. Escalation

If a complaint cannot be resolved directly, we encourage the parties to seek resolution amicably before pursuing formal legal remedies.

5. Governing Law

Disputes relating to the platform are governed by the laws of the Federal Republic of Nigeria and are subject to the exclusive jurisdiction of the courts of Lagos State.
